IMPORTANT NOTICE: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. THEY CONSTITUTE A BINDING LEGAL AGREEMENT BETWEEN YOU AND THE BANGBROS NETWORK. BY ACCESSING, BROWSING, SUBSCRIBING TO, OR OTHERWISE USING ANY PORTION OF THE BANGBROS NETWORK, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND EXPRESSLY AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, YOU ARE STRICTLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONNECT IMMEDIATELY.

1. Acceptance of Terms and Age Verification

These Terms and Conditions ("Terms") govern your use of the BangBros website, its affiliated domains, mobile applications, and all associated content, products, and streaming services (collectively referred to as the "Network" or "Services").

CRITICAL WARNING CONCERNING AGE: The Network contains adult-oriented content, sexually explicit material, and profanity. Access to the Network is strictly limited to individuals who are at least eighteen (18) years of age, or the legal age of majority in the jurisdiction from which they access the Network, whichever is greater. By entering the site, creating an account, or purchasing a subscription, you represent, warrant, and legally swear under penalty of perjury that: (a) you meet the minimum age requirements; (b) you are accessing the Network voluntarily and knowingly for your own personal use; (c) the adult content provided does not violate the community standards of the jurisdiction in which you reside; and (d) you will not permit any minor or unauthorized person to view or access the materials available on the Network. We reserve the absolute right to demand documentary proof of age at any time and to terminate your access instantly if we suspect fraudulent representation.

To access premium features, high-definition streaming, and exclusive content, you must register for a membership account and purchase a subscription.

A. Account Security

You are solely responsible for maintaining the strict confidentiality of your username, password, and account credentials. You agree to notify BangBros immediately of any unauthorized use of your account or any other breach of security. The Network holds no liability for any losses incurred due to third-party access to your account resulting from your failure to secure your credentials. You may not share, sell, rent, or transfer your account access to any other individual.

B. Billing Practices and Auto-Renewal

By providing a credit card or other payment method, you authorize BangBros (and our designated third-party billing providers) to charge the applicable subscription fees, taxes, and any other charges you incur in connection with your use of the Services. Unless otherwise stated during the checkout process, all subscriptions are subject to automatic renewal. Your payment method will automatically be charged at the start of each new billing cycle (e.g., monthly, annually) at the then-current standard rate until you actively cancel your subscription.

C. Cancellation and Refund Policy

You may cancel your subscription at any time by logging into your account dashboard, visiting the billing section, and following the cancellation procedures, or by contacting our customer support team directly. Cancellations must be processed before the next billing cycle begins to avoid further charges. Access to premium services will continue until the end of your current paid period. Due to the digital, immediately consumable nature of our content, all sales are considered final and non-refundable, except where explicitly required by applicable consumer protection laws.

3. Intellectual Property Rights and Copyright Policy

The BangBros Network is a premium content creator. We invest heavily in our production, talent, and technology. As such, all content, materials, and intellectual property found on the Network are vigorously protected.

Ownership: All video content, photographic images, graphic designs, logos, text, software code, user interfaces, audio files, and the compilation of all materials on the Network are the exclusive property of BangBros or its licensors and are protected by United States and international copyright, trademark, trade dress, and other intellectual property laws.

Limited License: Subject to your strict compliance with these Terms and the payment of all applicable subscription fees, BangBros grants you a limited, non-exclusive, non-transferable, and revocable license to access and stream the content strictly for your personal, non-commercial use.

Strict Prohibitions: Under no circumstances may you, directly or indirectly:

• Download, copy, reproduce, or capture any streaming video content without utilizing the official download features explicitly provided within your premium membership dashboard.
• Distribute, display, broadcast, sell, license, or exploit any content on third-party tube sites, torrent networks, peer-to-peer file-sharing platforms, or social media networks.
• Remove, alter, or obscure any copyright, watermark, or trademark notices incorporated into the content.
• Utilize automated scripts, scrapers, bots, or data-mining techniques to extract data, videos, or images from the Network servers.

BangBros actively employs digital watermarking and piracy tracking technology. We reserve the right to pursue severe civil and criminal penalties against any individual or entity found distributing our copyrighted material illegally, including damages, legal fees, and injunctions.

4. Acceptable Use and Community Standards

Certain areas of the Network may allow users to post comments, participate in live chats, or engage with performers and other members. You agree to use these interactive features responsibly and respectfully. You are strictly prohibited from transmitting any content that:

• Is defamatory, libelous, abusive, harassing, threatening, or constitutes a personal attack against performers, staff, or other users.
• Promotes illegal activities, violence, hate speech, or discrimination based on race, religion, gender, or sexual orientation.
• Contains unsolicited advertising, promotional materials, spam, or links to external, unaffiliated websites.
• Attempts to solicit personal, private contact information from performers.
• Introduces malicious software, viruses, or attempts to breach the security infrastructure of the Network.

BangBros reserves the absolute right, though not the obligation, to monitor, edit, or permanently remove any user-generated content that violates these guidelines, and to instantly terminate the accounts of repeat offenders without warning or refund.

5. Third-Party Links and Advertising

The Network may contain links to independent, third-party websites or services. These links are provided solely for your convenience. BangBros does not endorse, control, or assume any responsibility for the content, privacy policies, business practices, or products offered by these external sites. Your interactions with any third-party advertisers or vendors found on or through the Network are solely between you and that third party.

6. Disclaimer of Warranties

THE BANGBROS NETWORK, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, AND SERVICES, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, BANGBROS EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE NETWORK WILL BE COMPLETELY UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE THAT ANY SPECIFIC CONTENT, SERIES, OR PERFORMER WILL REMAIN AVAILABLE ON THE PLATFORM INDEFINITELY. YOUR USE OF THE NETWORK IS ENTIRELY AT YOUR OWN SOLE RISK.

7. Limitation of Liability

UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL BANGBROS, ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE NETWORK, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU FOR YOUR SUBSCRIPTION IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to fully indemnify, defend, and hold harmless BangBros, its affiliates, licensors, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from your violation of these Terms, your misuse of the Network, or your infringement of any intellectual property or other right of any person or entity.

9. Governing Law and Dispute Resolution

These Terms, and any dispute arising out of or relating to your use of the Network, shall be governed by and construed in accordance with the internal laws of the State of Florida, United States, without regard to its conflict of law principles.

Binding Arbitration Agreement: Any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by confidential, binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place exclusively in Miami, Florida. You and BangBros agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Judgment on the award rendered by the arbitrator(s) may be entered in any court having competent jurisdiction thereof.

10. Modifications to Terms and Services

BangBros reserves the right, at our sole discretion, to dynamically modify, update, or replace these Terms at any time. We also reserve the right to alter, suspend, or discontinue any aspect of the Services (including content libraries, pricing, and platform features) without prior notice. Material changes to these Terms will be indicated by an updated "Effective Date" at the top of this document. It is your responsibility to review these Terms periodically. Continued use of the Network following the posting of any changes constitutes your binding acceptance of those modifications.

11. Severability and Waiver

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of these Terms shall continue in full force and effect. The failure of BangBros to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
